Stamp duty is a state tax on the sale deed, so the rate depends on where the property is, not where you live. It is charged on the higher of two numbers: the price in your agreement, or the government's minimum value for that locality. That minimum is called the circle rate in UP, Delhi and Haryana, the ready reckoner rate in Maharashtra and the guideline value in Karnataka and Tamil Nadu.
Registration is a separate fee paid at the sub-registrar's office when the deed is recorded. Most states charge 1% of the value, but some cap it (Maharashtra at ₹30,000, Punjab at ₹2 lakh) and Haryana charges fixed amounts by value band. Add the two together to get the money you need over and above the price of the home.
Several states cut stamp duty when a woman is the buyer or a co-owner. Delhi charges women 4% against 6% for men, Haryana 5% against 7% in urban areas, and Uttar Pradesh gives a 1% rebate on homes worth up to ₹1 crore. Gujarat waives the registration fee for a sole woman buyer instead. Registering jointly with a woman family member can save lakhs on a large purchase, but the concession only works if she is a genuine co-owner on the deed.
The most common mistake is budgeting stamp duty on the discounted deal price when the circle rate for the area is higher. The sub-registrar will charge on the circle rate, and the difference has to be paid on the day. The other is forgetting that a home loan doesn't cover these charges, so they come out of your own pocket along with the down payment.
On whichever is higher. If the agreement value is below the circle rate or guideline value for the locality, duty is charged on the circle rate.
Generally no. Banks treat stamp duty and registration as the buyer's own contribution, so plan to pay them from savings along with the down payment.
Only under the old tax regime. Stamp duty and registration paid on a residential house can be claimed in the year of payment within the overall ₹1.5 lakh limit (the old Section 80C, now Section 123 of the Income-tax Act, 2025, which applies from 1 April 2026). The default new regime does not allow it.
Stamp duty is paid once, when the sale deed or registered agreement is executed. Some states charge duty on the agreement for sale itself; check your state's rules before signing.
