What is environmental clearance (EC)?

Environmental clearance is prior approval under the EIA Notification, 2006 that larger building and township projects need before work starts. For most housing projects it is granted by the State Environment Impact Assessment Authority (SEIAA).
The thresholds are in the schedule to the 2006 notification. Building and construction projects with a built-up area of 20,000 sq m or more and below 1,50,000 sq m fall under item 8(a). Townships and area development projects covering 50 hectares or more, or with a built-up area of 1,50,000 sq m or more, fall under 8(b). A mid-size project of 400 or 500 flats will almost certainly need one.
The EC letter carries conditions: rainwater harvesting, sewage treatment capacity, green cover, parking, dual plumbing, limits on drawing groundwater during construction. The developer is supposed to file compliance reports every six months. When those conditions are ignored, residents pay for it later, with an STP too small for the occupancy or borewells sealed after handover.
The EC also caps built-up area. If a developer later wants more towers or floors than it covers, it needs an amended clearance. Building beyond the EC is one of the grounds on which the National Green Tribunal and state authorities have halted projects around NCR, Mumbai and Bengaluru.
Ask for the EC letter and compare its built-up area with the sanctioned plan and the RERA filing. Clearances can also be searched on PARIVESH, the environment ministry's portal.
A 14-tower project near Sarjapur Road declares 2,10,000 sq m of built-up area in its RERA filing, but its EC from Karnataka's SEIAA covers 1,40,000 sq m. The gap means either an amendment is pending or something is wrong, and the buyer should ask which.
Skipping the EC because it sounds like builder paperwork. It decides how much can legally be built and whether the water and sewage arrangements will cope.

Does a small building need environmental clearance?
Not under the 2006 notification if the built-up area is below 20,000 sq m. Local building bye-laws may still require rainwater harvesting and similar measures.
Can construction start before the EC is granted?
No. The notification requires prior clearance, and work started without it can be stopped and penalised by the environment authorities.
