What is fire NOC?
Also called: fire safety certificate, fire clearance, fire NOC for building, Form B fire certificate
Issued by the state fire service, a fire NOC certifies that a building meets fire safety norms. High-rise and larger buildings need a provisional NOC at the plan stage and a final one before the occupancy certificate is issued.
Which buildings need one depends on state law, height and use. The National Building Code, 2016 treats buildings of 15 metres and above as high-rise, and most states use a similar cut-off for residential towers. Inspectors look at staircases, refuge areas, fire lifts, sprinklers, hydrants, wet risers, the fire water tank, space for fire tenders to turn and the width of the approach road.
There are two stages. The provisional NOC comes before the plans are sanctioned. The final NOC follows inspection of the finished building and is a condition for the OC in almost every city. In Mumbai redevelopment projects, the final fire NOC is often the item holding up the OC for the upper floors.
After handover the duty moves to the residents. In Maharashtra, the Maharashtra Fire Prevention and Life Safety Measures Act, 2006 requires owners or occupiers to have the systems checked by a licensed agency and to file a Form B certificate twice a year, in January and July. Plenty of societies forget until a notice turns up. Other states require periodic renewal of the NOC for certain building types.
When you inspect a flat, see the final fire NOC, walk the refuge floor and the staircases, and check that the hydrant system actually holds pressure rather than just being installed.
A 32-floor tower in Thane gets its OC only after the final fire NOC is issued. Two years on, the society gets a notice for not filing Form B, and the licensed agency charges about ₹60,000 for the inspection and repairs to the sprinkler pumps.
Thinking the fire NOC is a one-time builder formality. Residents inherit the upkeep and the certification, and a neglected system can hurt an insurance claim after a fire.
