What is occupancy certificate (OC)?

In short

An occupancy certificate is the local authority's permission to live in or use a building. Section 2(zf) of the RERA Act describes it as a certificate permitting occupation of a building that has provision for civic infrastructure such as water, sanitation and electricity.

The OC comes from whoever sanctioned the plans: the municipal corporation in Mumbai or Pune, the Noida or YEIDA authority in Gautam Buddh Nagar, DTCP for Haryana's licensed colonies, BBMP or BDA in Bengaluru. Before issuing it, the authority checks that the building matches the sanctioned plan, that the fire department has given its final NOC, that the lifts are certified and that water and sewer lines are connected.

Without it the building isn't legally fit to occupy, however finished it looks. Section 11(4)(b) of the RERA Act puts the job of obtaining the OC on the promoter. Section 19(10) then gives the buyer two months from the OC to take possession, and Section 17 expects the conveyance deed to be registered within three months of the OC where local law is silent. In Rajendra Kumar Barjatya (December 2024), the Supreme Court directed that water, electricity and sewer connections be given only against a completion or occupancy certificate.

Builders sometimes hand over keys "for fit-outs" before the OC arrives. That puts you in a building on temporary construction power, with no society yet and, in Maharashtra, in a flat you're not legally allowed to occupy. Banks funding a resale purchase ask for the OC as routine, so a flat without one is harder to sell later too.

An OC can be partial, covering certain towers or floors. Read which wings and floors it names.

Example

In a 22-storey tower in Andheri East, the municipal corporation issues an OC for floors 1 to 16 while the upper floors wait on a premium payment. A buyer on the 19th floor who is offered possession has, on paper, no permission to live there yet.

Watch out

Don't pay the final possession instalment until you've seen the OC, or a part OC naming your tower and floor. A possession letter is not a substitute.

Questions people ask about occupancy certificate (OC)

Can I get a home loan for a flat without an OC?

For an under-construction flat, yes, because the bank lends against the approvals and pays in stages. For a ready or resale flat, most banks and housing finance companies won't lend without the OC.

How do I check whether a building has an OC?

Ask the builder for a copy and look for it in the project file on the state RERA portal, where builders are expected to upload it. For an older building, the society office or the municipal ward office can confirm.
