What is partial occupancy certificate?

Also called: part OC, partial OC, part occupation certificate, tower-wise OC

In short

Where only some towers, wings or floors of a project are ready, the authority can issue a partial occupancy certificate that lets people move into those parts alone while the rest is built or awaits approval.

Phased townships run on part OCs. A developer on the Dwarka Expressway may finish six towers out of fourteen, get an OC for those six and start handovers while cranes stay up on the rest. In Mumbai redevelopment the part OC is often floor-wise: the lower floors, including the rehab flats for the original residents, get certified while the sale floors above wait for a fire NOC, an FSI premium or a height clearance.

It's legal and common. The catch is what it leaves out. The clubhouse, pool and second entry road are often in a later phase, so the amenities in the brochure may trail your keys by two years. Trucks and construction material move through a campus where families already live, and handing maintenance to a society gets messy when only half the owners have possession.

Read the certificate itself. It lists the towers, wings or floors covered, sometimes with conditions such as finishing a fire staircase or a road within a set time. If your flat isn't on that list, there's nothing you can lawfully occupy yet, and an offer of possession from the builder shouldn't be treated as one that stops delay interest.

In a resale purchase, the bank's lawyer will check that the specific flat is covered and will decline the loan if it isn't.

Example

A Worli redevelopment gets a part OC for floors 1 to 24. The developer asks a buyer on the 31st floor to pay 95% and take "fit-out possession". The buyer can refuse, and delay interest keeps running until an OC covers floor 31.

Watch out

Paying the possession demand after a WhatsApp update saying "OC received" without checking whether your tower and floor are actually named.

Questions people ask about partial occupancy certificate

Can I register my flat when there is only a part OC?

Yes. Registering your sale deed doesn't depend on the OC, and a part OC that names your tower and floor is what banks and the society need. Conveyance of the land to the whole society usually waits for the last phase.

Does a part OC stop delay interest?

Only for the units it covers, and only once the builder makes a proper offer of possession. For a flat outside it, the Section 18 interest keeps running.
