What is RERA agent registration?

In short

Section 9 of the RERA Act requires a property broker to register with the state authority before helping sell plots or flats in a registered project. The agent's registration number should appear on the paperwork for every deal they facilitate.

The definition in Section 2(zm) is wide. It catches anyone who negotiates or acts for one party in a sale for a fee, whether it's called brokerage or commission, and anyone who introduces buyers and sellers through any medium. The channel partner at a Thane site office, the Gurugram dealer with a WhatsApp list and a two-person firm in Indirapuram are all meant to register. The state issues a number valid for a fixed term, and it has to be renewed.

Section 10 spells out what a registered agent owes you. They can't help sell units in an unregistered project, they must keep books of account and records, they can't misrepresent a project's approvals or quality, and they have to help you get the documents you're entitled to at booking. Break the rules and Section 62 allows a penalty of ₹10,000 for every day the default continues, up to 5% of the cost of the unit.

Maharashtra has gone further than most states. MahaRERA requires agents and their sales staff to clear a competency exam, and developers there are told not to deal with unregistered brokers. Elsewhere enforcement against small dealers is patchy, so the checking falls to you.

Ask for the number before paying any token through a broker and search it on the state portal. The name, firm and validity shown there should match the visiting card.

Example

A broker in Wakad, Pune has a MahaRERA agent number printed on his card, but the portal shows the registration lapsed last year. The buyer asks for proof of renewal before signing a brokerage letter for 1% of a ₹95 lakh flat, which is ₹95,000 plus GST.

Watch out

Paying brokerage in cash to an unregistered dealer on the strength of verbal promises, then having no paper trail when the booking goes wrong.

Questions people ask about RERA agent registration

Does a broker handling only resale flats need RERA registration?

Section 9 is written around units in registered projects, so a pure resale in an old society may fall outside it. Many brokers register anyway, and a registered agent gives you a regulator to complain to.

How do I check a broker's RERA registration?

Search the name or number under registered agents on the state RERA website. It shows the validity period, the address on record and any orders against the agent.
