What is penthouse?

Penthouse is the sales name for a flat on the top floor, or top two floors, usually larger than the flats below and with a private terrace. The word has no legal meaning in India, so the terrace rights in your agreement matter far more than the label.
What you're really paying for in a penthouse is the terrace. The RERA carpet area definition excludes an exclusive open terrace, so the agreement has to list it separately, with its area and a clear statement that it is for your exclusive use. If it doesn't, the terrace may legally be part of the common area, and a future managing committee can open it to everyone or let the builder use it for water tanks and mobile towers.
Builders usually charge for the terrace at a lower rate than for the carpet area, or bundle it into a lump sum. Either is fine as long as it's written down. Ask whether the lift machine room, overhead tank and solar panels are on your terrace or on a separate roof above it. That decides how often maintenance staff will be walking through your space.
Top floors come with practical costs that brochures skip. Heat gain through the roof in Delhi, Hyderabad and Ahmedabad summers is real, waterproofing has to be redone every few years, and water pressure from the overhead tank is at its lowest. A private plunge pool needs the structural design to carry its load from the start; it can't be added later without a structural engineer's certificate.
Finally, check the FSI. If the project hasn't used all its permissible floor area, your penthouse may not stay the top floor.
A penthouse in Hebbal, Bengaluru, is sold as 4,200 sq ft RERA carpet plus a 1,500 sq ft exclusive open terrace, with the terrace charged at 40% of the carpet rate. Both areas and both rates are listed separately in the agreement for sale.
Relying on the sales team's word that the terrace is private. If the agreement and the RERA filing don't say 'exclusive open terrace' with an area, assume it isn't.

Is the penthouse terrace included in carpet area?

Do penthouses pay higher maintenance?
Usually, because maintenance is billed per sq ft and many societies include the terrace area in the calculation. Check the rate and the area basis before booking.
