What is UDS (undivided share of land)?

In short

UDS is the fraction of the project's land that legally belongs to you when you buy a flat. You own a share of the whole plot jointly with the other owners, not a marked piece of it.

The usual method is simple proportion: your flat's super area divided by the total super area of the project, multiplied by the land area. Some builders use carpet area instead. Either way, the figure should be written into your sale deed in sq ft, and all the flats' shares together must add up to the whole plot.

In Chennai, Bengaluru and Hyderabad, buyers talk about UDS far more than people in Mumbai or NCR do, partly because of how flats were historically registered in Tamil Nadu. There, the land share was bought through a sale deed and the building through a separate construction agreement, and stamp duty was levied on the land at guideline value. The state has since moved towards registering flats at a composite value, so ask the sub-registrar's office how your purchase will be documented.

The reason to care about a number you can't stand on is simple: buildings age and land doesn't. When a 30-year-old building in Adyar or Malleswaram goes for redevelopment, the builder's offer and your new flat's size depend heavily on your share of the land. The same is true if the building is damaged beyond repair or acquired for a road.

Higher FSI means more flats on the same land and a smaller UDS for each. A tower of 40 floors gives every owner a thinner slice than a four-storey block on the same plot.

Example

On a 1.5 acre (65,340 sq ft) plot on OMR, Chennai, with 3,00,000 sq ft of total super area, a 1,100 sq ft flat carries a UDS of about 240 sq ft. The sale deed should state that figure and the survey numbers of the land.

Watch out

Some older Bengaluru apartment deeds don't mention UDS at all, or the builder kept the land in its own name. Check this before buying resale, because fixing it later needs every owner and the builder to cooperate.

How is UDS calculated?

Divide your flat's super area by the total super area of all flats in the project, then multiply by the total land area. Check that the builder has used the same basis for every unit.

Can I sell my UDS separately from my flat?

No. The land share goes with the flat and can't be sold, gifted or mortgaged on its own.
