What is setback?

In short

Building bye-laws make every structure stand back from its plot boundaries by a minimum distance at the front, sides and rear, and that compulsory open strip is the setback. Its width depends on plot size, road width and building height.

Setbacks exist for light, air, fire-tender access and future road widening. Tall buildings need wider margins, which is why a 20-storey tower in Gurugram sits on its plot very differently from a two-storey house in a Jayanagar lane. For high-rises, the fire rules effectively require a driveable clear space around the building, and the margins are sized with that in mind.

In apartment projects you rarely see a setback problem, because the plan is approved as a whole and the fire department checks the margins before the occupancy certificate. The trouble is in independent houses, builder floors and old resale property. Owners enclose the front setback for a car porch, add a room over the side margin, or put the staircase outside the permitted line. It's common enough that people stop thinking of it as a violation.

Your bank thinks of it that way. A valuer comparing the building against its sanctioned plan will mark any construction in the setback as a deviation, and the loan will be sized on the approved area only. Municipal bodies periodically issue notices and, now and then, send a bulldozer. When a road is widened, the front setback may be what gets taken, sometimes with TDR in compensation and sometimes without.

Before you buy a house or a floor, lay the sanctioned plan next to the building and walk the boundary.

Example

A resale house in Jayanagar, Bengaluru, is offered at ₹3.4 crore with a 'bonus' ground-floor room. The buyer's lawyer finds that room sits in the side setback; the bank sanctions the loan on the approved area only and the buyer negotiates ₹22 lakh off.

Watch out

Paying for rooms or covered area built in the setback. It isn't legal area, you can't insure or mortgage it properly, and it can be demolished.

Questions people ask about setback

Can setback violations be regularised?

Sometimes, through a state or municipal regularisation scheme on payment of a penalty, and only within limits. Many schemes don't cover setback encroachments at all, so don't buy on the promise that it can be fixed later.

How do I check the setbacks of a house?

Get a copy of the sanctioned building plan from the seller or the municipal office and measure the open margins on site. An architect or the bank's valuer can do this in an hour.
