What is security deposit (rent)?

In short

A rental security deposit is the refundable amount a tenant pays the landlord at the start, to cover unpaid rent, bills or damage. How much you pay depends mostly on the city and on state law: from one or two months' rent in Delhi NCR to as much as ten months in Bengaluru.

Custom has always set the number more than law. Bengaluru landlords long asked for 10 months' rent, though six has become more common in the newer tech corridors. Mumbai usually runs at three to six months, Chennai around three to five, Hyderabad two to three, and Delhi, Noida and Gurugram one to two.

Law is catching up in a few states. The Model Tenancy Act, 2021, released by the Centre, caps the deposit at two months' rent for homes and six for commercial premises, but it only applies where a state adopts it. Uttar Pradesh's 2021 tenancy law uses the same two-month cap for residential property. Tamil Nadu's 2017 landlord-tenant law limits the advance to three months' rent. Maharashtra and Karnataka have not legislated a cap, so the market number holds there.

The deposit belongs to you, and the landlord should return it when you vacate, minus documented deductions. Legitimate deductions include unpaid rent, pending electricity or maintenance bills, and damage beyond normal wear. Repainting after a three-year stay is usually treated as wear and tear and shouldn't come out of the deposit unless the agreement says otherwise.

Protect yourself at the start. Record the flat's condition in photos and a signed inventory, pay the deposit by bank transfer, and write the refund timeline into the agreement, for example within 15 days of handing over the keys. Landlords who hold large deposits sometimes stall, and a clear clause gives you something to point to.

Example

A tenant in HSR Layout pays ₹3.2 lakh deposit (8 months) on a ₹40,000 rent. On leaving after two years, the owner deducts ₹14,000 for a broken wardrobe door and a pending BESCOM bill and returns ₹3.06 lakh within the agreed 15 days.

Watch out

Handing over the deposit in cash with no receipt. If the landlord later denies the amount, you have nothing to prove what was paid.

Questions people ask about security deposit (rent)

Can a landlord keep the whole deposit?

Only if the unpaid dues or damage actually add up to that much. Deductions should be itemised; you can send a legal notice and approach the civil court or rent authority if the landlord won't refund.

Can I adjust the deposit against the last months' rent?

Many tenants do, but it's risky unless the agreement allows it, because the landlord then has nothing to cover damage. Agree on it in writing first.
