What is encumbrance certificate?

Also called: EC, Form 15, Form 16, nil EC

In short

An EC is the sub-registrar's extract of every registered transaction on a property over a chosen period, such as sales, mortgages and leases. A 'nil' EC means nothing was registered against it in that window.

The EC is a southern habit that has slowly spread. In Tamil Nadu, Karnataka, Andhra Pradesh, Telangana and Kerala, no lender or careful buyer goes ahead without one, usually covering 13 to 30 years. Form 15 lists the registered transactions found; Form 16 is the nil certificate when there are none. Tamil Nadu's TNREGINET and Karnataka's Kaveri portal let you apply online by survey number or document number.

Elsewhere the idea exists under other names. In Maharashtra, lawyers take a 30-year search of the sub-registrar's index and read the Index II entries. In Delhi and UP, the search is run at the sub-registrar's office against the property's registration details.

Its limits are what catch people out. An EC shows only documents registered at that sub-registry. It won't show a mortgage created by depositing title deeds with a bank where the state doesn't require the memorandum to be registered, a pending civil suit, an unregistered agreement to sell, or property tax owed to the municipality. So an EC is necessary without being a clean chit on its own.

Cross-check it against the original documents, ask the seller for loan-closure letters from any lender that appears on it, and search the CERSAI registry, which records charges created by banks and housing finance companies, for anything the EC can't see.

Example

Before buying a ₹58 lakh flat in Coimbatore, a buyer downloads a 30-year EC from TNREGINET and finds a 2021 mortgage deed in favour of a cooperative bank. The deal goes ahead only after the seller produces the registered receipt deed showing the loan was repaid.

Watch out

Taking an EC for just the last 10 or 13 years because it's quicker and cheaper. Title problems tend to sit further back, so ask for 30.

How long does it take to get an EC?

Where records are digitised, as in Tamil Nadu and Karnataka, an online EC often comes the same day or within a few days. Older periods may need a manual search at the sub-registrar's office, which can take a week or two.

Is an EC needed for a home loan?

In the southern states almost every lender asks for one, typically for 13 to 30 years. In other states the bank's lawyer runs an equivalent search at the sub-registrar's office.
